These Terms and Conditions govern your use of the www.temooljee.com website (the "Site") and your relationship with Temooljee & Co Ltd ("Temooljee", "we" or "us"). Please read them carefully as they affect your rights and liabilities under Seychelles law. If you do not agree to these Terms and Conditions, please do not register for or use www.temooljee.com. Please note that to use any of the services provided on the Site, you must register as an authorized user.

1. Use of the Site

   The Site is provided to you free of charge for your personal use, subject to these Terms and Conditions. By using the Site, you agree to be bound by these Terms and Conditions. These govern your use of the Site and all services provided in connection with it. All orders and purchases made on the Site are also governed by the terms and conditions of Temooljee & Co Ltd and the online payment conditions of Nouvobanq.

   We may revise these Terms and Conditions at any time without notice to you.

3. Registration

   To register with www.temooljee.com you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are true, accurate and complete. You must inform us immediately of any changes to your registration information by updating your personal details through your online account.

4. Password and Security

   When you register to use the Site, you will be asked to create a password. You must keep this password confidential and not disclose or share it with anyone. You are responsible for all activities and orders that occur or are submitted under your password. If you suspect someone else knows your password, please notify us immediately at info@temooljee.com. You may not use anyone else's password at any time without the permission of the password holder.

   We may require you to change your password or suspend your account if we believe there is likely to be a security breach or misuse of the Site.

5. Delivery

   Our delivery service is available within the main islands of Seychelles, subject to our delivery grid. Deliveries will not be made on certain national holidays. A responsible adult must sign the copy of the invoice at the time of delivery. Goods once delivered as per the order cannot be returned or exchanged except as described in section 11.

6. Excluded Services

   The services provided by the Site do not include provision of computers or other necessary equipment to access the Site. To use the Site you require Internet connectivity and appropriate telecommunication links. We shall not be liable for any costs you may incur for Internet access.

7. Intellectual Property

   The content of the Site is protected by copyright, trademarks and other intellectual property rights. You may view and print pages for personal use only. You may not otherwise reproduce, modify or distribute any Site content without written permission. No license is granted to you to use any of our trademarks or those of our partners.

8. Limitations

   You may not use the Site to:

   • Disseminate unlawful, harassing or obscene material;
   • Encourage conduct that may constitute a criminal offence or civil liability;
   • Gain unauthorized access to other systems;
   • Interfere with other users' enjoyment of the Site;
   • Transmit or store copies of copyrighted material without the owner's consent.

   You agree to indemnify Temooljee for all losses, damages, costs and expenses arising out of your misuse of the Site.

9. Availability of the Site

   We aim to provide the best service possible but do not guarantee the Site will always be fault-free. If a fault occurs, please report it to info@temooljee.com and we will try to fix it promptly.

   Access may be occasionally restricted for repairs or updates.

10. Our Right to Suspend or Cancel Your Registration

    We may suspend or cancel your registration immediately if you breach these Terms and Conditions. You may cancel your registration at any time by informing us in writing. Termination will not affect either party's rights or liabilities.

11. Online Order Refunds

    Refunds or replacements are not facilitated except for genuine product quality issues or if the product standard is below acceptable norms. We encourage customers to place orders carefully. Exchanges may be considered under exceptional circumstances at our discretion. No cash refunds are issued except for valid cases approved by Temooljee.

12. Our Liability

    The Site is provided without any warranties or guarantees. We do not guarantee it will meet your requirements or be error-free. We accept no liability for:

    • Incompatibility with your equipment;
    • Technical issues;
    • Unsuitability or unreliability of content;
    • Inadequacy to meet your needs.

13. Third Party Websites

    The Site may link to other websites. We are not responsible for their availability or content and you use them at your own risk.

14. Advertising and Sponsorship

    Advertisers and sponsors are responsible for ensuring submitted material complies with Seychelles law. We are not liable for any error or inaccuracy in advertising or sponsorship material.

    Your access and use of the Site is governed by the laws of Seychelles. Any legal proceedings shall be brought before a competent court in Seychelles.

16. International Use

    We make no promise that materials on the Site are appropriate for use outside Seychelles. Accessing the Site from territories where its contents are illegal is prohibited.

17. Deletion of Your Account

    You may request account deletion at any time by emailing info@temooljee.com or calling us.

18. Miscellaneous

    You may not assign or transfer your rights under these Terms. If any provision is found invalid, other provisions remain effective. We shall not be liable for failure to perform due to causes beyond our control including natural disasters, civil unrest, pandemics or government restrictions.

    Except where expressly stated, the Site and all content are provided "AS IS" and "AS AVAILABLE". We disclaim all warranties, express or implied, including fitness for a particular purpose. Any content you download is at your own risk.

20. Limitation of Liability

    Temooljee shall not be liable for any direct, indirect or consequential loss or damage arising from your use of the Site, except for gross negligence or willful misconduct.

21. Indemnity

    You agree to indemnify Temooljee and its employees, directors and agents from all claims, liabilities, damages, losses or expenses arising from your use of the Site.

23. Legal Compliance

    You may not use the Site in violation of applicable laws or export restrictions.

24. Payments

    Payments are securely processed by Nouvobanq. Your card details are encrypted and transmitted securely. All payments will be accepted in Seychelles Rupees (SCR) or USD as displayed.

25. Deals and Promotions

    Deals and promotions are subject to availability and may change without notice. Offers apply within stated limits and conditions.

26. Saved Carts

    We may store your saved carts for a limited time for convenience. Temporary carts may expire automatically.

27. Foreign Currency Transactions

    Foreign currency payments are valid only for approved payment cards issued outside Seychelles. Refunds for foreign currency orders will be returned to the original card within 5–7 working days.

28. Product Availability

    Products may run out quickly and we cannot guarantee availability at all times. If an item is unavailable, a refund or replacement will be offered.

29. Special Terms for Liquor and Tobacco

    Where we supply liquor or tobacco, you warrant that you are above the legal age and comply with Seychelles law. Proof of age may be required. We reserve the right to refuse or limit orders for such products.

30. Delivery Conditions

    Orders placed before 11 a.m. may be delivered same day where possible. Orders after 11 a.m. will be delivered next day or as agreed. Additional delivery fees may apply.

31. Click and Collect

    If available, Click & Collect is subject to collection time slots. Uncollected orders may be cancelled.

32. Corporate Social Responsibility

    Temooljee may run community projects or donation programs. Terms will apply to any such initiative.
